3. PURPOSES OF THE DATA PROCESSING

Opus processes and uses your personal data to

3.1 Performance of the contract

Personal data provided by you in the context of a contract are used for processing or are necessary and required for the conclusion of a contractual relationship and are therefore processed on the basis of legal entitlements in fulfilment of the contract.

3.2 Marketing purposes

A processing of your personal data for marketing purposes (in particular the transmission of information for the purpose of advertising by fax, letter, e-mail or SMS).

3.3 Newsletter

Personal data provided by you when registering for the Opus newsletter will be used exclusively for sending the newsletter by e-mail, unless you give us your separate consent for further use.
 

4. WEBSITE

In connection with the website www.opus.at operated by Opus, personal data are processed in order to:

to make our website available to you and to further improve and develop it;

  • to be able to create usage statistics;
  • to recognize, prevent and investigate attacks on our website;
  • To be able to answer your questions;

5TH WEBSHOP

If you wish to use your online customer account online for the first time, you must register by providing your contact details:

  • First name, last name
  • E-mail address
  • Display name and password

 
The following data processing is necessary for the processing of a sales contract via our webshop:

  • First name, last name, display name
  • Invoice and delivery address
  • E-mail address
  • Phone number (optional)
  • Ordering information (optional)
  • Invoice and payment data

 
You can change your data via in your online customer account as well as in writing at office@opus.at after sufficient identification.

This data processing is based on Art. 6 Para. 1 lit b DSGVO and serves the execution of the contract.

If you use your online customer account, we store the data necessary for the fulfilment of the contract, including details of the method of payment. Furthermore, we store the voluntary data provided by you for the time of your use of the online customer account, unless you delete it first. All details can be changed at any time in the password-protected customer area or under our contact details.

The legal basis for this is Article 6 paragraph 1 letter b) DSGVO, i.e. you provide us with the data on the basis of the respective contractual relationship (e.g. maintaining your online customer account, processing a sales contract) between you and us. For the processing of your e-mail address in the case of a purchase via our websites/applications, we are also obliged to send an electronic order confirmation due to legal requirements in the General Civil Code (ABGB) (article 6 paragraph 1 letter c) DSGVO).
Insofar as we do not use your data for advertising purposes (see 3.3.), we store the data collected for the execution of the contract until the expiry of the statutory or possible contractual warranty and guarantee rights. After this period has expired, we retain the information required under commercial and tax law for the contractual relationship for the legally specified periods. For this period, the data will be processed again solely in the event of a review by the tax authorities.

We will pass on information on your delivery address to logistics companies and shipping partners commissioned by us.

In order to ensure that the goods are delivered according to your wishes, we transmit your e-mail address and, if necessary, the telephone number provided to the logistics company and/or shipping partner we have commissioned to take care of the delivery. These partners may contact you in advance of the delivery in order to agree the details of the delivery with you. The respective data will be transmitted solely for the respective purposes and deleted after delivery.
 

6. USE OF COOKIES

On our website and web shop we use so-called cookies to make our offer more user-friendly, more effective and safer. A "cookie" is a small text file which we transmit via our web server to the cookie file of the browser on the hard disk of your computer. This enables our website to recognise you as a user when a connection is established between our web server and your browser. Cookies help us to determine the frequency of use and the number of users of our website. The content of the cookies we use is limited to an identification number that no longer allows a personal reference to the user. 7. LEGAL BASES

Opus processes personal data for the performance of a contract or pre-contractual measures or in order to comply with legal obligations or with your prior consent. By giving your consent, you also confirm that you are 16 years of age or that you have the consent of your legal representative.
 

8. DURATION OF STORAGE

We will delete your data after termination and processing of your contract or after expiry of the statutory guarantee, warranty, limitation and statutory retention periods, unless you give us separate consent for processing and use of this personal data beyond this.
 

9. HANDOVER

We will not pass on your data to third parties without your express consent, a legal basis or it is necessary for the fulfilment of contractual relationships.
 

10. HER RIGHT

You are entitled to a) check whether and which personal data we have stored about you and to receive copies of such data; b) request the correction, completion or deletion of your personal data; c) restrict the processing; d) under certain circumstances, object to the processing of your personal data or revoke the consent previously given for the processing; e) request data transferability; f) know the identity of third parties to whom data is transferred; and f) file a complaint with the data protection authority.
